I don't think McCourt can take the MLB to court, they are within their rights to take over financial responsibilities, and I don't think the board of owners will back McCourt.
He will take MLB to court, because that is what he does best. Drag things out through litigation.
However, he will not win since all owners must sign an agreement not to sue MLB for whatever reason, and this falls under that.

The argument in his camp is that: "If ARod is worth $252 million, then I'm worth $XXX million".. The problem with that is that it is already looking like ARod is overpaid, and his production will continue to dip due to age.
