That team at the end of Avengers was cap's side. At least thats what's being reported. Absolutely no way scarlet witch will be on Stark's side.

I don’t want to give too much away, but needless to say, the generalities of the act are the same. Something happens, perhaps it’s cumulative for things that have happened though all of the movies leading up to this point. It has made the governments of the world say “we need to have some oversight of these guys. They need to report to somebody. So it becomes more… it falls under that umbrella, rather than “you have to take off your mask.” It’s not about the secret identity thing, as much as it is about, overall, who reports to who, and who can agree to oversight committee. Because as of now, in Avengers 2, there is no more security council, there is no SHIELD, obviously. Stark is paying for it, Captain America is running it, and things occur that will make governments begin to question.

Yea sunshine, I was assuming that the lineup at the end was more or less Cap's team with SW, Vision sitting out and War Machine defecting. But it looks like I'm wrong already.

It's difficult to say right now who is siding with the government but if I were to guess it would be Cap.
Caps new group or institution looks very militaristic (always thought that is what he meant by saying he was home in the end, he belongs in a military base) so I would assume that is funded by the government. It might be what they feel is a good replacement for Shield?
I am sure they will re-purpose Spidey in the film, maybe he kind of flips side or can't decide and the war ends with him in the middle, like Ash int he first Pokemon film but obviously not die but just severely hurt and him being a little kid gives a bigger impact? Just brainstorming.

In the comics Cap was working for Shield and when the registration act was proposed he just walked out, why can't he be working for the gov't right up until they propose stricter controls?
Cap joining the government could be as simple as them promising not to repeat shield's mistakes. In the end, somebody has to join the government side and I don't see it being Tony.
