Sony was ready to give Tobey the money. That wasn't the big problem with why SM4 and SM5 never got made.
Besides they only have so many choices now. Think about it. You either stick with Garfield (but apparently he's burned his bridges), or you risk a new guy. Now while the James Bond approach will work, they'd be changing Spidey only after 2 movies while trying to keep some of the past ASM continuity. A brand new face as Peter Parker, to me the only way they don't lose money on that is if they do the opposite of what the MCU does and keeps the Spidey mask on for most of the movie. Like wait until 40 min until the mask comes off and we see PP's face.
The other choice and it's a choice cuz Tobey isn't that old is to bring the first movie Spidey back that's a familiar face to all - that was arguably in your best Spidey movies - and just have a great movie to boot (that I assume since Marvel is apart of the plans this SPidey will be in the MCU as well).
Now that I think about it they can bring Tobey back, some of that Raimi continuity and just say some of the ASM continuity was his past when he was in HS (just change up his HS experience a bit by extending it, cut out the Osborn's, etc.) and don't use any of those past villains. Just move forward.
If they cast Tpbey, that's how you know they desperate. Tobey wanted a bunch of money for SM4 and Sony didn't wanna give it to him. If they hire him now and pay him what he originally wanted

Tobey was my dude and I loved the original series but there are plenty of other actors who can be a good Spidey if Sony looks hard enough. Tobey had his run.

I actually have nothing against Andre Garfield and feel when in costume along with the writing he was better at being the wise cracking Spider-Man than Tobey. I can only knock him for not being as good a PP as Tobey was but his biggest problems the Spidey movies he was in weren't all that good.
Anyway, I think we all should face facts, Sony is done with Garfield. aint even that I want him out of the role. It's over.
Ohhh besides the soft Michael Cera-ish type voice, I just didn't care for his potrayal.^
