The ways the laws were in place (if you believe the official story) before 9/11 was that the CIA couldn't work alongside the FBI unless they had a MASSIVE reason to do so, reasons that would have involved breaking laws in place at the time. So when these dudes started coming into the US, the CIA lost track of them, and couldn't collaborate with the FBI on such measures above ground.
