The NCAA is teethless. They’re going to grab on to guidance from an admin that’s out of the door in 3 days as pertains to a hot button issue that’s sure to result in a lot of unnecessary heat? You’re much more confident than me. The NCAA doesn’t want to govern. That’s the problem hereTitle IX almost definitely won’t be enforced the same way for sure.
But Trump wont hit the ground running and this won’t be a priority for him, so a change back probably won’t happen before July 1.
Until then, this is enough for the ncaa enforcement arm to pretend to have the authority to enforce the collective rules.
Any attempt at enforcement will result in a lawsuit for sure. I’m just responding to the idea it won’t matter. For the purposes of college football and basketball both parties have mostly moved in lockstep. Idk that there isn’t a behind the scenes desire from most schools to have NIL and rev share reigned in a little, which is why I question whether there will be the political incentive for Trump to prioritize this.The NCAA is teethless. Trump has floated getting rid of the Dept of Education in general . No one is going to save the NCAA from being a feckless organization at this point. It’s going to be business as usual with NIL until the top 60-80 schools break away. This “guidance” is not going to reign in NIL at all.Any attempt at enforcement will result in a lawsuit for sure. Would take a much longer post to ponder how a lawsuit would resolve the issue of the NIL limits coming from the federal government in this specific instance and not just a dumb ncaa rule.

Look I agree, but for the purposes of discussion today, the school’s have to comply with that. Federal funding is predicated on title IX compliance. Now will Trump’s Dept of Ed actually go after title IX violators like Obama’s did? Absolutely not. But it’s interesting from an academic perspective.
