Halp bros I just did 3 months in the county, but my cases were dismissed. Where I was arrested my truck was towed. Now the impound is threatening to auction my truck unless I pay $5000 on a truck I’ve already paid off. Anyone ever been through a situation like this? Do I have any legal options?

Buy the truck back when it goes into auction. Here in Cincinnati the PD does an auction on Saturday twice a month. 5 year old truck generally go for $3-4k, 10 year old truck 2-3 and 20 year old truck goes for 1000.

From day 1, you shoulda gave a family member/friend power of attorney to get the truck released and all it woulda cost was $100. So $5k after 90 days sounds on the mark. The best you can do is see if they'll let you remove your belongings.

Yeah I can’t just give it away rebuilt my whole LS engine before they locked me up.

You better just pay up, i wouldnt even risk it going to auction. I dont trust tow truck drivers and companies. Had to give em almost 600 when my tahoe got towed

Did u have a lawyer on ur case? I'd go there first if so. Otherwise u can get a free consultation from one and see what they advise. More than likely ur gonna have to pay though, tow truck company has nothing to do with your case and ultimately it was your responsibility to have someone get it out. You can try reaching out to them to and see if they're willing to work with u, maybe set up a payment plan.

Piggybacking off the above post.....If you have the title get a title loan for the amount and just pay that. EDIT: DO NOT got to a check cashing or payday loan with this. Your local community credit union or even you bank may already do title loans. The interest rate should be low because you got collateral.

I did have a lawyer but he said he did enough to get the felony dropped and that it would be a conflict of interest between the police and the towing company. Thank you for the response bro’s. I have until the 21st to figure something out.

Is the lawyer saying they did enough on your case so they don't wanna deal with the impound? Not sure i understand what you mean. Just asking the lawyer about the policies and procedures about all this shouldn't be a problem. Obviously if you want them to pursue action you'll have to pay them again.

Some states have laws regarding being impounded and having charges dropped. You'd have to speak to someone who knows the specifics for your state. There's usually free or low cost legal resources if you are low income. U need to be proactive and start calling around to see if theres anything that can be done. I'd try speaking to the precinct as well.
