I searched but hadn't seen this posted anywhere. I posted in this forum because the shoes are Dunks

Eddie Van Halen is suing Nike. Here is the script:

Eddie Van Halen claims Nike is guilty of walking all over him -- by saying the shoe giant jacked his trademarked black, whiteand red design for a new line of sneakers.

ELVH Inc. -- Eddie's company -- filed a federal lawsuit against Nike last week, laced with allegations of copyright infringement. The suit claims a seriesof designs Eddie trademarked -- designs which have prominently been displayed on his guitars since 1978 -- were lifted by Nike without his consent.

The suit is not only seeking monetary retribution -- it also calls for "the impoundment and destruction of all footwear."

IMO. He has no case. What do you think?

I don't know if there is really a case. Criss-crossed white and black lines isn't exactly an original design in itself.

This is def a reach for evh. People nowadays are just looking to get free coin any where they can. Note, evh just wants the profit.

I would like to see if Nike counter sues on evh's converse all star copies.

I doubt there is a suit. Maybe some of you graphic designers and art directors can chime in. As I understand it...there is a FAIR USE clause or statementunder all copyrights. Also as long as you change it by a minimum of 30% or some arbitrary number you can do it. That is the difference of an INSPIREDshoe..vs a rip off or fake shoe. Jordan rips off their own shoe designs everyday. So yeah Eddie has a very shallow case. I think the shoes in question arenot a blatant copy and as someone else said above you cannot lay claim to red, white and black stripes.

Vans did a collaboration w/ X-Large a few years ago or so where they used the Van Halen print on a pair of sk8 hi's
