Jordan 12 for $30? worth it or not?

Someone is selling me his jordan 12 black/red for only $30. See the pics below. Do you guys think its worth it? Don't you think its pretty beat?

Also, i'm planning to buy a Penny 2. i'm size 9.5 or should i get a size 10? I heard that those run a little small.
